I see a big flaw in the ToC rules listing: Terms 3. Code of Conduct. wrote:
Use any robot, spider, Game search/retrieval application or other manual or automatic device or process to retrieve, index, "data mine" or in any way reproduce or circumvent the navigational structure or presentation of the Game or its contents; This would probably mean more then half the GL usebase should be banned, because im quite sure most people use either notepad, word, excel or other means to note down information about the game such as planets. Heck, even users using the browser can be subject to this rule and become banned because, you see.. browser has built in search function. So anyone saving little text into a notepad should then be banned according to theese code of conduct rules since they ALSO got search function.. --- Dan: i guess you only want people to sit and click-click-clickety-click to find stuff, flip page after page after page of planets to find "that one".. making your click count go +=1000000.

As I said in another post regarding the terms of service, it seems like these are usually made especially broad in order to cover their bases, and only apply them to things that are actually a problem. So, I guess he could use this against anybody who copies down planet information or uses ctrl+f to find an alert, but it seems like he wouldn't.

If you are referring to kaos, bunny or other persons. this thread isnt about that, but in general, most games where people interact and have large info to keep in mind, such as GL will get noted down by alot of people, and according to the terms, even writing down info with pen and paper os bannable offence..

Not all items in the TOS are insta-ban. People still get warnings for stuff. Who said everything in there results in a ban?

Dan,
Legally the term forbidding people from writing game info down be pen/pencil and paper is unenforceable in any court in the USA. Not to mention I can not imagine a serious game player who hasn't noted a planet that needs improvement, is being attacked, etc....
These terms should be updated. If you have lot's of money hire an attorney who has worked on other facebook games.

Data mining (the analysis step of the Knowledge Discovery in Databases process, or KDD), a relatively young and interdisciplinary field of computer science, is the process of extracting patterns from large data sets by combining methods from statistics and artificial intelligence with database management
It's a pretty broad definition. I think it's used in this case more to protect intellectual property than to prevent player's from having an unfair advantage. I can figure out in my head that each rank takes forty xp more than the last so the equation for XP required to rank would be (R+1)*40. And so total XP would be R!*40(R+1). I didn't write anything down so the rule may or may not apply. I think if I extracted a few more formulas for things like damage amounts, invasion success rates, planet settling costs, scan success rates and a bunch of other things and used them to create "Galaxy Friends", the hottest new game on FB with better graphics and marketing, that it would get me a lot more than just banned. GL has a financial interest at heart like any other business. It is going to seem rather subjective why someone might be banned for that reason and broad vaguely defined rules allow more of that. I don't know if agreeing to the terms of service is legally binding to more than just service though, and that could just be more of a liability if you are banned without actually violating the TOS. Honestly, if you want to nitpick something so insignificant, tell us why we should care.

I think Ferrus has it right. ToS/ToC are generally not enforced strictly on some points - such as this. I, personally, have never needed to put anything into notepad etc.. I seriously doubt people would get banned for it. I see a big flaw in the ToC rules listing: 3. Code of Conduct. wrote: Use any robot, spider, Game search/retrieval application or other manual or automatic device or process to retrieve, index, "data mine" or in any way reproduce or circumvent the navigational structure or presentation of the Game or its contents; Reproduce: Copy. Noting things into wordpad does not replicate navigation. Circumvent: Avoid. If I were to suddenly decide: HEY! I'm going to build an engine that takes me directly to my planets! Then that would be an offense, by the ToS. Again, writing down info on notepad does not avoid navigation.

These terms should be updated. If you have lot's of money hire an attorney who has worked on other facebook games. That's not how these things work at all; this isn't a law passed by goverment. He can't force people not to do things, but he can ban them from the game for doing it, which is what these terms are for; you agree to these things if you want to play.
