Cannot Attack - Planet Owner is below rank 20

A legion Mate alerted a planet for me, owned by what is (obviously) an inactive rank 13 player. I went to attack it and the attack button is grayed out, with the message when you mouse over, "Cannot Attack - Planet Owner is below rank 20"
Is it possible that one of the recent updates changed the requirements for attacking these worlds? I know I used to be able to take them, because the player had lost their newbie protection due to action or inactivity...?

Their planets are immune from attack until they hit Rank 20, or fourteen days after they hit Rank 10, whichever comes first.

I have a planet that is held by an inactive lvl 3. Is it just useless now then?

Once they go inactive it will be able to be taken.

The protection expires after 2 weeks. Inactivity is irrelevant in this instance.
